Amendment to the Illinois Health Care Right of Conscience Act Is Now Law

Earlier this week, Governor Pritzker signed the amendment (Senate Bill 1169) to the Illinois Health Care Right of Conscience Act (HCRCA) into law.

This new legislation clarifies that it is not a violation of the HCRCA for persons, associations, employers and others to take measures to prevent COVID-19. Measures include imposing vaccination, testing and masking requirements related to employment, along with the ability to enforce those measures.

ISMS’ longstanding position has been that the Act applies to healthcare professionals, facilities and other entities as defined in the Act – and not to a broader audience.
