  • Feds Issue New 'Guidance' Rules Regarding Timely Release of Patient Records

    On January 7, the Department of Health and Human Services released new guidance regarding patient access to medical records under the Health Insurance Portability and Accountability Act's (HIPAA) Privacy Rule. The guidance reportedly is intended to give patients timelier and easier access to their medical information.

    HHS' guidance advises physicians and other covered entities of their responsibilities when a patient requests protected health information. The guidance clarifies the types of information patients have a right to receive, as well as circumstances under which patient requests can be denied. The guidance also addresses what a physician can and cannot do with respect to establishing policies for record access requests and the manner in which requested information is provided or transmitted to the individual including by email and other electronic means.
