  • Dentists Restrained from Providing Plethora of Vaccines

    Governor Quinn signed into law legislation that allows dentists to provide flu shots to persons 18 and over with specific restrictions and requirements.

    S. B. 3409 (as originally introduced) and H.B. 5574 would have allowed dentists to provide vaccines for shingles, HPV, hepatitis B and influenza. ISMS strongly opposed this legislation, which resulted in amendments to S.B. 3409 to limit dentists to providing flu shots for adults only and to require adherence to these restrictions and requirements:

    • The dentist must have a valid prescription or standing order by a physician who already is administering vaccines to patients.
    • A dentist is only authorized to provide the vaccine if contracted with and credentialed by the patient's health insurance plan.
    • If the patient is a Medicare or Medicaid client, the dentist must be enrolled in those programs before providing a vaccine.
    • The new law contains several notification requirements to ensure that a physician continues to receive information about a patient's vaccination history.

    This legislation is subject to a sunset date of Jan. 1, 2020, at which time it will be reviewed by legislators and either extended or repealed.
