It is unfortunate yet not surprising that in her Q&A with your paper (QA:ITLA president elect Cates challenges caps, June 16, 2005), Ms. Judy Cates ignores pertinent facts and perpetuates damaging myths about Illinois hostile legal environment. Perhaps a few points of clarification will explain how the recently passed medical liability reform bill will help our state.

The 14,000 members represented by the Illinois State Medical Society, and more than two-thirds of our states citizens disagree with your June 5 editorial (Gov should veto malpractice caps). The legislation recently passed by the Illinois General Assembly will ensure those injured by medical negligence receive fair and timely justice, and that all citizens will have improved access to needed medical care. You chose to ignore the worsening health care access crisis which this legislation addresses.

Doctors agree, Illinois patients must not be forgotten in efforts to pass litigation reform (Patients are ignored in reform equation, April 27, 2005). Sadly, what is frequently overlooked in this debate is one basic fact: 72 percent of the public supports strong legal reforms including a cap on non-economic damages.

No one wants a bad doctor practicing medicine, and that includes other doctors. Illinois physicians have for years supported a strong medical disciplinary process. But to say Illinois litigation crisis is the result of sub-par medical care flies in the face of reason and fact.

Your March 27th article, Doctors split over curbs for insurers, failed to make a major point: ISMS supports insurance reform. What we dont support are provisions that would raise physicians insurance premiums or further deter liability insurers from doing business in Illinois. This type of junk reform would further weaken Illinois medical liability insurance market and drive more doctors away.
